Hanged on 23 February 1946, General Tomoyuki Yamashita became the first military commander in history convicted of war crimes for 'failing to control' his troops, even though, as the prosecution itself conceded, he had neither ordered nor committed the atrocities in question. The 1945 Manila trial that produced the doctrine of command responsibility known as the 'Yamashita standard' became a foundational principle of later international war-crimes law.
The atrocities of 1944–1945 in the Philippines were committed by Japanese troops as MacArthur's army tried to recapture the islands. MacArthur convened a military commission of five American generals, none of them trained in the law, and the U.S. Supreme Court upheld the conviction, with two justices invoking, for the first time in U.S. legal history, the concept of international human rights. Allan A. Ryan provides a detailed legal-historical reconstruction of the trial and traces its implications for later international law.
Allan A. Ryan is a former U.S. Justice Department attorney who served as director of the Office of Special Investigations, hunting Nazi war criminals in the United States.
