Nazi rule is commonly understood as a regime of pure terror and lawlessness. Jens Meierhenrich's major ethnographic and theoretical study of the legal order of the Third Reich, drawing on Ernst Fraenkel's foundational The Dual State (1941), demonstrates otherwise: the Third Reich operated two parallel legal orders simultaneously, a normative state where ordinary law continued to function alongside a prerogative state of arbitrary violence (Maßnahmenstaat, the "measures state"). The regime did not destroy law; it weaponised it.
Meierhenrich rehabilitates and extends Fraenkel's concept into a broader theory of authoritarian legalism, drawing on extensive archival material.
