When Israel put Adolf Eichmann on trial in Jerusalem in 1961, a fundamental question hung over the proceedings: was this justice, or theatre? Yosal Rogat's short legal-philosophical essay is one of the foundational meditations on the Eichmann case, frequently cited alongside Hannah Arendt's Eichmann in Jerusalem as a touchstone of the early jurisprudential debate over what the trial of an Argentine-kidnapped Nazi by an Israeli court actually meant for the rule of law.
The essay analyses the legal and jurisdictional questions raised by the trial: the legitimacy of Israel's exercise of universal jurisdiction over crimes committed before the State existed, the issue of retrospective legislation, the use of the death penalty, and the relationship between trial and political theatre, exploring the tensions between law, justice, and historical memory.
Yosal Rogat (1929–1976) was professor of law at Stanford. The original 1961 study was published for the Center for the Study of Democratic Institutions, Santa Barbara, California.
