The Nazi regime did not invent its own legal system from scratch, and the Federal Republic never fully purged it. Michael Stolleis's collection of essays examines how law functioned under the Third Reich and how Nazi-era jurisprudence was received (and quietly continued) in the post-war Federal Republic, tracing the deep continuities running from Weimar through National Socialism into postwar German law.
Stolleis surveys constitutional, judicial, agrarian, administrative, civil, and business law, arguing that all types of law were affected by the political realities of National Socialism. The work shows clearly the continuities between the Nazi period and the postwar period, demonstrating that the law under National Socialism did not make a complete break with the law during the Weimar Republic, nor did the law of the Federal Republic nullify all of the laws under National Socialism. Stolleis stresses the importance of researching Nazi law in order to confront ethical problems in today's legal profession.
